Terms of Service

1. Service
Givanta provides software for configuring and operating donation kiosks on compatible devices with supported third-party payment hardware and services.
2. Eligibility and accounts
You must be authorised to act for the organisation using Givanta. You are responsible for administrator access, device security, the accuracy of organisation details and compliance with laws applying to your fundraising activities.
3. Subscriptions and device limits
An active subscription is required to accept payments through Givanta. The Single Device Plan permits one active Givanta payment device. The Multi Device Plan permits up to five active Givanta payment devices. An attached or embedded payment reader does not consume a separate licence.
4. Billing
iOS subscriptions are billed through Apple and are subject to Apple’s payment, renewal, cancellation and refund processes. Changes to subscription level may take effect immediately or at the next renewal according to Apple’s subscription rules.
5. Transaction fees
Givanta does not add a per-transaction fee or take a percentage of donations. Standard fees charged by Square or another supported payment provider apply under your agreement with that provider.
6. Payment providers
Payments are processed by Square or another supported provider, not by Givanta. Availability, settlement, refunds, disputes, hardware operation and payment acceptance are subject to the provider’s terms. Givanta does not guarantee that a third-party service will always be available.
7. Acceptable use
You must not use Givanta unlawfully, misrepresent fundraising purposes, interfere with security controls, attempt unauthorised access, reverse engineer protected service components except where law permits, or use the service to process prohibited activity.
8. Availability and updates
We may update, improve, suspend or discontinue parts of the service. We aim to provide a reliable service but do not promise uninterrupted or error-free operation.
9. Liability
To the maximum extent permitted by law, Givanta is not responsible for indirect loss, loss of donations, payment-provider outages, hardware failure, connectivity problems or acts of third parties. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable rights under Australian Consumer Law.
10. Termination
You may stop using Givanta and manage your subscription through Apple. We may restrict access where a subscription expires, device limits are exceeded, security is compromised or these terms are materially breached.
